Terms of Service

These Terms of Service (“Terms”) govern your access to and use of TheRundown.GG (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, whichever is greater, to use the Service. By using the Service, you represent that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

The Service provides sports analytics, projections, matchup grades, and related informational content. The Service does not constitute betting advice, investment advice, or a guarantee of any outcome. Sports outcomes are inherently uncertain. You assume all risk for any decisions you make based on information from the Service, including any wagers placed with third-party operators.

We are not affiliated with Major League Baseball, any sportsbook, or any betting operator. We do not accept wagers and are not a gambling service.

Certain features may require a paid subscription. If you subscribe, you agree to pay all applicable fees as described at the point of purchase. Unless otherwise stated:

• Subscriptions auto-renew at the end of each billing period until canceled.
• You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
• Fees are non-refundable except where required by law or as expressly stated on the pricing page.
• We may change subscription fees on prospective billing periods with reasonable advance notice.

You agree not to:

• Scrape, copy, or republish substantial portions of the Service without our written permission;
• Reverse-engineer, decompile, or attempt to derive source code or proprietary models;
• Resell, sublicense, or commercially redistribute access to the Service;
• Use the Service to violate any law, infringe rights of others, or transmit malware;
• Probe, scan, or test the vulnerability of the Service or circumvent security features;
• Use automated tools (bots, crawlers) other than well-behaved search engine crawlers without permission.

The Service, including all content, modeling, projections, design, and code, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. All rights not expressly granted are reserved.

MLB team names, logos, and player names referenced in the Service are the property of their respective owners and are used for identification purposes only under applicable nominative-fair-use principles.

The Service may link to or integrate with third-party services. We are not responsible for those services and your use of them is subject to their own terms and privacy policies.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PROJECTIONS, GRADES, OR DATA WILL BE ACCURATE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Service.

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will survive.

These Terms are governed by the laws of the State of Nevada, U.S.A., without regard to conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located within the State of Nevada, and you consent to personal jurisdiction there.

We may revise these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
